At Delilah & Mia, we treat your memories with the same care we treat our own families'. Below is the legal framework that helps us keep your data safe and our magical book-making machine running smoothly.

Welcome to Delilah & Mia! These Terms of Service ("Terms") govern your use of our website and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Age Requirement

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you meet this requirement.

2. User Accounts

You are responsible for safeguarding your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. User-Generated Content (Your Photos and Story Ideas)

Our Service allows you to upload photos and submit text ("User Content") to create personalized storybooks.

Your Responsibility

You are solely responsible for your User Content. You represent and warrant that:

License You Grant to Us

By uploading User Content, you grant Delilah & Mia a limited, non-exclusive, worldwide, royalty-free license to use, modify, reproduce, and create derivative works from your User Content. This license is granted for the sole purpose of generating, printing, and fulfilling your storybook order. We will not use your photos or personal story details for any other purpose, such as marketing, without your explicit permission.

Copyright Complaints (DMCA)

If you are a copyright owner and believe that content on our Service infringes your copyright, you may submit a takedown notice to our designated agent at dmca@delilahandmia.com. Please include: (1) your contact information, (2) identification of the copyrighted work, (3) identification of the infringing material and its location, (4) a statement of good faith belief that the use is unauthorized, (5) a statement under penalty of perjury that your notice is accurate, and (6) your physical or electronic signature.

Prohibited Content & Moderation

You may not use our Service to create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. Our AI systems include automated content moderation to filter inappropriate inputs. Attempts to circumvent these safeguards or generate inappropriate content featuring children will result in immediate account termination without refund. We reserve the right to refuse service and cancel orders that violate these standards.

4. Ownership of the Final Product

Upon purchase, you own your physical storybook and receive a perpetual, non-exclusive license to use the digital version for your own personal, non-commercial use. You may share it with family and friends, print additional copies for personal use, but you may not resell it or use it for commercial purposes.

Note on AI-Generated Content: The illustrations in your storybook are generated by artificial intelligence. Under current U.S. Copyright Office guidance, purely AI-generated images may have limited or no copyright protection. This means that while you own your physical book and have full rights to use your storybook personally, the AI-generated illustrations themselves may not be eligible for traditional copyright registration.

Delilah & Mia and its licensors retain all ownership rights to the Service itself, including our website, technology, AI models, and pre-existing art styles.

5. AI-Generated Content & Artistic Variation

The Service utilizes advanced artificial intelligence (AI) to generate stories and illustrations. While we strive for high-quality results, AI-generated content may occasionally contain artifacts, stylistic inconsistencies, or anatomical imperfections (e.g., in hands or background details).

By purchasing a book, you acknowledge that these variations are inherent to the technology and do not constitute a defect in the product.

Image Regeneration Feature

If you are unsatisfied with an AI-generated illustration, you may use our regeneration feature to generate alternative versions. Each unlocked story includes 15 regeneration credits that can be used on any page or the cover. Additional regeneration credits are available through our upgrade packs at the prices displayed during checkout. The regeneration feature is your primary remedy for artistic dissatisfaction with AI-generated illustrations.

6. Refund & Return Policy

Because each Delilah & Mia storybook is custom-made to order with your unique photos and dedication, all sales are final.

We cannot accept returns or offer refunds for customer errors, including typos in the dedication, uploading low-quality photos, or changing your mind after the order is placed.

Artistic Dissatisfaction: For dissatisfaction with AI-generated illustrations, please use the regeneration feature described in Section 5 above. You may generate multiple versions of any illustration until satisfied. While subjective artistic preference is generally not grounds for a refund, if an illustration contains significant anomalies that cannot be resolved through regeneration, please contact our support team to discuss options.

Manufacturer Defects: If your book arrives damaged or with a manufacturing defect (e.g., torn pages, binding issues, or printing errors clearly distinct from AI art style), please contact us at support@delilahandmia.com within 7 days of delivery with a photo of the issue. We will happily send a free replacement.

7. Purchases and Payments

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service. We use third-party payment processors to handle all transactions.

8. Indemnification

You agree to indemnify, defend, and hold harmless Delilah & Mia, its affiliates, officers, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, your improper use of the Service, or your violation of any law or the rights of a third party (especially regarding the copyright of your uploaded photos).

9. Disclaimer of Warranties; Limitation of Liability

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

In no case shall Delilah & Mia, our directors, or employees be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of the Service or any products procured using the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.

11. Dispute Resolution & Arbitration

Informal Resolution First: Before filing any formal dispute, you agree to contact us at support@delilahandmia.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If we cannot resolve the dispute informally, you and Delilah & Mia agree that any dispute, claim, or controversy arising out of or relating to these Terms, our Privacy Policy, or the Service (including claims regarding privacy, biometric data, or AI-generated content) will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in Clark County, Nevada, or remotely via video conference at your election.

Class Action Waiver: You and Delilah & Mia agree that any arbitration or court proceeding will be conducted only on an individual basis and not as a class action, collective action, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against Delilah & Mia.

Small Claims Exception: Either party may bring an individual action in small claims court if the claim qualifies.

12. Changes to Terms of Service

You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website.
